Update To Master Builders New Homes Building Contract

The Master Builders New Homes Building Contract has been updated on the Master Builders eContracts portal. Here are the changes we have noted from the previous version of the contract:

The Contract now defines “Adjoining Owner” and “Adjoining Property”.

The Contract expands on the Builder’s ability to request evidence of capacity to pay during the Contract in clause 11.3.

Additionally, the Contract also expands on the materials to be supplied by, or items of work to be carried out by the Owner in clause 11.11.

Clause 12.6 of the Contract now details adjustments to be made in the next Progress Claim if the Owner’s variation increases the Contract Price, as opposed to the original Contract, which simply lists what adjustments should be made to the next Progress claim if Owner’s variation decreases the Contract Price.

Similarly, the Contract now also details the course of action to be made in the next Progress Claim should the Builders variation increase the Contract price in clause 13.4.

Further, the Contract notes new reasons for which the Builder is entitlement to suspend the Contract with the Owner, which relate to the Owners’ actions - see 16.1 i) and j).
